What is a notice to vacate?

A notice to vacate is a written document that's given to your landlord or property manager to tell them you intend to end your lease. This letter is required for most rentals, no matter how long the lease is. A notice to vacate is required even if your lease has an official end date. It can be helpful to mark this day in your calendar when you first sign a lease so you don't miss it.

When to give your notice to vacate

When to give your letter of intent to vacate will depend on your lease. While most properties need 30 days of notice, some require 45 or 60 days. Read over your lease to confirm the timing requirements.

Tips for writing your notice to vacate letter

• Before you begin this process, thoroughly read your lease. It will include instructions on what to include, how to deliver the notice and any other requirements needed.
• Even if your landlord doesn't require a formal notice to vacate letter, you should send one anyway. This will legally protect you.
• Type your letter so that you can keep a copy of it. If a handwritten signature is required, you can print out the letter and sign it. If your landlord requires the 30-day notice to be in writing, be sure you photocopy it to keep for your records.
• Be sure to include the date on your notice to vacate. This will document that you sent it in the correct time frame.
• The notice to vacate should be straightforward and polite. Do not bring up any outstanding issues or complaints you have.
• Include reliable contact information as well as your forwarding address. Your landlord will need this to send you back your deposit.
• Keep in mind, this isn't the final step before moving out. You'll still need to do a property walk-through with the owner to document anything that should be fixed or deducted from the deposit.
• If you are breaking your lease, be prepared to endure some additional financial repercussions. Breaking a lease without cause can cost you as much as two months' rent and your deposit.
